1. Eligibility
To use The Lawns App, you must:
• Be at least 18 years old
• Create an account with accurate and up-to-date information
• Agree to be legally bound by these Terms and the Privacy Policy
2. Role of The Lawns App LLC,
• The Lawns App LLC, is a marketplace platform that connects individuals seeking
services (“Customers”) with independent service providers (“Workers”).
• The Lawns App LLC, is not a party to contracts between Customers and Workers.
• Workers are independent contractors, not employees or agents of The Lawns App
LLC,.
• We do not guarantee the quality, safety, or legality of services. All services are performed at your own risk.
2.1 Platform Only
Lawns is a technology services provider and marketplace platform only. Lawns does not provide, perform, or contract for any services offered by Workers.
Lawns does not employ Workers and does not control, supervise, direct, or manage the manner, method, or means by which any services are performed.
2.2 No Agency or Employment Relationship
Workers are independent contractors. Nothing in these Terms shall be construed to create any employment, agency, joint venture, partnership, or franchise relationship between Lawns and any
Worker or Customer.
Workers are solely responsible for:
• Determining how and when to perform services
• Supplying their own tools, equipment, and materials
• Complying with all applicable federal, state, and local laws
• Obtaining any required licenses, permits, or insurance
2.4 No Guarantee or Warranty
To the fullest extent permitted by applicable law, Lawns makes no representations, warranties, or
guarantees regarding:
• The quality, safety, legality, or suitability of services
• The reliability, honesty, or qualifications of any Worker or Customer
• Whether a Worker is licensed, insured, bonded, or certified
• The accuracy of any user-provided information
All services are arranged and performed at the sole risk of the Customer and the Worker.
2.5 User Responsibility
Customers are solely responsible for:
• Evaluating and selecting Workers
• Confirming qualifications or insurance
• Providing safe access to the property
• Securing valuables and pets
• Verifying completion of services
Workers are solely responsible for:
• Performing services safely and professionally
• Carrying appropriate insurance
• Paying all required taxes
• Complying with applicable labor and contractor laws
2.6 Payments and Escrow
Lawns may facilitate payment processing through third-party payment processors (such as Stripe or similar providers). Lawns does not hold funds as a trustee or fiduciary for either party.
Any escrow or payment facilitation services are administrative in nature and do not create a partnership, agency, or employment relationship.
2.7 Release
To the maximum extent permitted by law, Users release and hold harmless Lawns, its owners, officers, members, affiliates, and employees from any and all claims, damages, demands, or disputes arising out of or related to:
• Services performed by Workers
• Interactions between Users
• Property damage
• Personal injury
• Payment disputes
• User conduct
3. Account Registration
To access the Platform, you must create an account:
• Workers must complete identity verification and connect a valid payment account (e.g., Stripe Connect).
• Customers must provide a valid payment method.
• You are responsible for all activity on your account and must maintain confidentiality of your login credentials.
3.1 Eligibility
To access or use the Platform, you must:
• Be at least eighteen (18) years of age
• Have the legal capacity to enter into a binding contract
• Not be barred from using the Platform under any applicable federal, state, or local law
• Not have been previously suspended or removed from the Platform
By creating an account, you represent and warrant that you meet all eligibility requirements.
3.2 Account Creation
To access certain features of the Platform, you must create an account and provide accurate, current, and complete information. Workers
Workers must:
• Complete identity verification as required by Lawns or its third-party verification providers
• Connect and maintain a valid third-party payment account (such as Stripe Connect or another approved payment processor)
• Provide any tax documentation required by applicable law
• Provide any licenses or documentation required to legally perform services
Lawns reserves the right to approve, deny, suspend, or revoke Worker accounts at its sole discretion.
Customers must:
• Provide and maintain a valid payment method
• Authorize Lawns and its payment processor to charge the payment method for agreed services, fees, and applicable charges
3.3 Accuracy of Information
You agree that all information provided during registration and thereafter is true, accurate, current, and complete.
You agree to promptly update your account information if it changes.
Lawns is not responsible for any loss or damages resulting from inaccurate, false, or outdated account information.
3.4 Account Security
You are solely responsible for:
• Maintaining the confidentiality of your login credentials
• Restricting access to your account
• All activities conducted under your account
You agree to immediately notify Lawns of any unauthorized use, suspected breach, or security compromise.
Lawns shall not be liable for any loss, damage, or liability arising from unauthorized access to your account, except to the extent required by applicable law.
3.5 One Account Rule
Individuals may not create multiple accounts without written permission from Lawns.
Individuals are permitted to have a worker account and a customer account. Licensed businesses are permitted to generate addition accounts as necessary for their business model.
Lawns reserves the right to suspend, deactivate, or terminate duplicate, fraudulent, or misleading accounts.
3.6 Background Checks and Verification (If Applicable)
Lawns may, but is not obligated to, conduct identity verification or background checks on Workers or Customers through third-party providers.
You acknowledge that:
• Verification or background checks, if conducted, may not be comprehensive
• Lawns does not guarantee the accuracy or completeness of any background screening
• You remain solely responsible for evaluating other Users
3.7 Suspension and Termination
Lawns reserves the right, at its sole discretion, to suspend, restrict, or terminate any account for:
• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Safety concerns
• Non-payment or payment disputes
• Risk to the integrity of the Platform
Lawns may take such action without prior notice.
4. Job Workflow
1. Customers post a job with details, photos, location, and a suggested budget.
2. Workers may accept or submit a counter-offer.
3. Once agreed, funds are placed into escrow.
4. The Worker travels to the job site, confirms arrival, and begins work.
5. Upon completion, the Worker uploads proof and marks the job complete.
6. Customers confirm completion and review the Worker.
7. If a Customer does not respond within 24 hours, the job is auto-confirmed, escrow is
released, and the Worker receives an automatic payment.
5. Payments and Fees
• Minimum job value: $20.
• Maximum job value: $500
• Platform fees:
◦ 10%
• A $1.00 transaction fee applies per job, payed by the customer.
• Workers receive net payment after deductions.
• Loyalty Bonuses:
◦ Loyalty Bonuses are provided between agreements with customer, workers, and
The Lawns App LLC.
6. Reviews and Ratings
• Both Customers and Workers must leave a 1–5 star rating and may leave a short (25-character max) review.
• Reviews must be truthful, respectful, and relevant.
• The Lawns App LLC, reserves the right to remove fraudulent, abusive, or irrelevant
reviews.
7. Cancellations and Refunds
A job may be canceled:
• By the Customer, before a Worker accepts.
• By the Worker, before arriving at the job site.
If a job is canceled after escrow but before work begins, funds are refunded to the Customer.
Disputes: The Lawns App LLC, support may review disputes, but final resolution is between Customer and Worker. The Lawns App LLC, does not guarantee refunds.
Customers shall have a period of four (4) hours following job completion to submit a dispute.
Upon expiration of this period, the customer forfeits eligibility for any refund.
8. Prohibited Conduct
Users may not:
• Misrepresent identity or qualifications
• Post fraudulent jobs or reviews
• Circumvent the The Lawns App LLC, platform to avoid fees
• Engage in abusive, illegal, or unsafe behavior Violations may result in suspension or permanent ban.
9. Intellectual Property
• All content on the The Lawns App LLC, platform (logos, icons, designs, etc.) is owned by The Lawns App LLC.
• Users may not copy, distribute, or use The Lawns App LLC, intellectual property without written permission.
10. Limitation of Liability
The Lawns App LLC, is not responsible for:
• Actions, inactions, or conduct of any user
• Damage to property, injury, or loss resulting from services
• Delays, disputes, or cancellations
To the maximum extent permitted by law, our liability to you is limited to the amount of fees paid to The Lawns App LLC, in the past 6 months.
11. Indemnification
You agree to indemnify, defend, and hold harmless The Lawns App LLC, its officers, employees,
and affiliates from any claims, liabilities, damages, or expenses arising from your use of the
Platform or violation of these Terms.
12. Governing Law & Dispute Resolution
• These Terms are governed by the laws of the State of West Virginia.
• Any disputes must be resolved in the courts located in Wood County, WV, unless
otherwise required by law.
• At The Lawns App LLC,’ discretion, disputes may first be submitted to binding
arbitration before court proceedings.
13. Changes to Terms
We may update these Terms at any time. Changes are effective upon posting to the Platform.
Continued use after changes means you accept the updated Terms.
